In Mexico, the Judicial Branch is in charge of imparting justice in the country. This power has a vision of recovering social peace and consolidating the rule of law. For this purpose, in the State of Jalisco, the Judicial Branch has a framework composed of the Supreme Court of Justice, Courts, and the Institute of Alternative Justice, among others.
The Institute of Alternative Justice of the Judicial Power of Jalisco (IAJ) is a government organism with technical and administrative autonomy in charge of providing services for the dissemination of the Culture of Peace and the application of Alternative Dispute Resolution Methods (ADR).
The IAJ acts through accredited and certified personnel to act as ADR facilitators; personnel who have assumed the obligation to watch over the fundamental rights and legal and legitimate interests of the community.
The ADRs carried out before the IAJ are the processes that exist as an alternative to a judicial process where controversies that people have are prevented and/or resolved in which, rather than imposing a solution, it allows the parties to create their own.
Once the ADR process has been submitted, resolved and settled, the parties enter into a Final Agreement, which is submitted to the IAJ for validation and thus obtain the status of an Executed Judgment.
Such quality of Executed Judgment implies that the agreement of the parties will have the character of a judgment issued by a Judge, so that, in the event of non-compliance of the parties with respect to the Final Agreement, they will be able to demand its compliance in a much more agile way (by way of enforcement) as it would be simply the execution of a judgment.
