Mexican Authority Issues Final Determination on Antidumping Investigation regarding Polyester Textured Yarn from China and India
On 29 September 2021, the Ministry of Economy published in the the final determination of the antidumping investigation on imports of polyester textured yarn from China and India. In this post, we summarize the most relevant aspects of the final determination.
Investigated Product: Polyester Textured Yarn (PTY)
Continuous textured textile filament yarn or polyester textured yarn (PTY), including all forms of PTY, which may vary in terms of denier, luster, and color, without changing its essential characteristics.
The Antidumping Duties on Polyester Textured Yarn
The Ministry of Economy imposed a definitive non-injurious antidumping duty (or lesser duty) of $0.532 dollars per kilogram on imports of PTY from China and India. However, the Ministry suspended the application of the antidumping duties due to extraordinary circumstances and excluded certain types of texturized polyester textile filament yarn.
Extraordinary Circumstances
The Ministry took into account the effects of the SARS-CoV2 virus (COVID-19), which has affected the textile industry, and therefore suspended the application of the antidumping duty for one year.
Product Excluded from Antidumping Duties
Considering importers’ arguments, the Ministry excluded certain types of polyester textile filament from the antidumping duties, per paragraph 259 of the Final Determination.
It should be noted that VTZ successfully represented the importers Hilos American & Efird de México, S.A. de C.V. and Gütermann Polygal Mexicana, S.A. de C.V., since with our legal defense we convinced the Ministry to exclude the sewing thread Twister Yarn T-18 and E 382 and/or Bauschgarn 100.
Exporters and VTZ
VTZ also represented exporting companies from the People’s Republic of China. The Ministry calculated a specific dumping margin to such exporters, as stated in paragraph 520 of the Final Determination.
The exporters we represented were the following:
- Jiangsu Hengli Chemical Fibre Co. Ltd.
- Tongkun Group Co. Ltd.
- Xiamen Xianglu Chemical Fiber Company Limited
- Xinfengming Group Huzhou Zhongshi Technology Co. Ltd.
VTZ also represented an Indian producer, Sarla, whose exported products were excluded.
