Arzinger defended the client's interests in a dispute with the russian federation for over UAH 1.1 billion.
Arzinger's litigation team successfully represented one of Ukraine’s largest solar energy producers in a high-stakes claim against the russian federation, obtaining a court judgment for damages exceeding UAH 1.1 billion.
This decision is one of the few significant cases involving damage recovery from an aggressor state, recognising that the harm was caused not by physical damage or destruction by military forces, but by the de facto loss of control over the asset following the occupation of the territory where it is located, despite the asset’s conditional integrity being preserved.
Furthermore, the court confirmed the client’s claim for lost profits, awarding USD 2.4 million in damages and thus fully satisfying the claim.
The team working on the project included founding partner Sergii Shkliar, managing associate Andrii Tyshchenko, senior associates Iryna Hutnik and Ivan Zalizniak, and junior associates Yana Nesterenko and Bohdan Sukhodolskiy.
