Arzinger defended the international agro-industrial company interests in the Supreme Court on the case disputed with the tax authority
Arzinger's Tax and Customs Litigation practice team successfully defended the interests of a leading international agro-industrial company specializing in the production and sale of oil and fat products and food ingredients. The Supreme Court made a final decision in a multimillion-dollar tax dispute.
The case complexity was caused by the fact that the client addressed Arzinger only at the stage of their cassation appeal, during a new round of case consideration, whilst a negative decision of the appellate court was taken. In addition, there was a significant amount of tax surcharges.
However, thanks to an effectively developed and implemented defense strategy, the Supreme Court supported Arzinger's lawyers' arguments regarding the absence of tax law violation in the client's actions. Thus, the court did completely satisfy the cassation appeal, ending the dispute that lasted 7 years round.
