TELLES’s Public Law team advised the Municipality of Lisbon in appealing the decision that refused the Court of Auditors’ prior approval of a concession contract in January 2019.
“It is a procedure that we are proud of, as far as the work we have provided as well as its recognition by the client. So much so that today we advise all the operations of the program, which aims to build up 7.000 dwellings in 107 buildings and to mobilize EUR 708M of total private investment”, as stated by (Head Partner of the Public Law team).
The team included managing associate and associates and , whom were entrusted with the various facets of the case (from a legal to a political-legislative standpoint) and achieved its main goal: the Court of Auditors granted its prior approval to the Municipality’s operation for Rua de S. Lázaro, in Lisbon. The overturn of the alleged unlawfulness that justified the refusal of the Court’s prior approval has now given place to an approval - granted without any mandatory recommendations.
This decision will allow the launch of the Affordable Rent operation, with its corresponding private investment. It will equally allow for the implementation of the public policy on affordable housing undertaken by the Municipality of Lisbon.
