Brooks Pierce is known for representation of debtors-in-possession, creditors, or trustees in Chapter 7 and Chapter 11 cases in complex bankruptcy litigation. This includes "bet-the-company" litigation for the survival/reorganization of the Chapter 11 debtor-in-possession, determinative of any return to creditors for a trustee, or defending similar claims filed against creditors and other parties dealing with such debtors-in-possession and/or trustees. 

We also regularly represent banks and other lenders on secured commercial and real estate loans in Chapter 11 cases. Additionally, we represent buyers of assets of operating companies in Section 363 sales from Chapter 11 debtors-in-possession or trustees.
