About

Provided by BTO Solicitors LLP

Well known for in-depth understanding of charity regulation and OSCR’s requirements, regulatory role and intervention powers, strengthened by Marion Davis’s accredited specialism in charity law and her secondment to OSCR.

Advice on transition to charity status and the implications of charity law on all aspects of client operations and governance. Our cross-disciplinary team provides a full legal service and addresses charity law issues as they arise, whether contract, property, regulatory, litigation or employment law.

Specialists in complex reorganisation applications under the Charities and Trustees Investment (Scotland) Act 2005, an invaluable option for clients constituted by Act of Parliament or trust deeds, where no other reorganisation route exists.

Clients range from international organisations and large national bodies to small grant-giving charities and voluntary organisations. Work includes advising:

  • The Richmond Fellowship Scotland on a series of construction contract disputes regarding a multi-million pound development and on all general property work.
  • The Royal National Lifeboat Institution on its Scottish operations, including its large number of Scottish lifeboat stations.
  •  A charity on an ongoing OSCR investigation into actions of former trustees and the impact of that on the charity’s activities.
  • Pursuing a court action for Quarriers in respect of its factoring role, the outcome of which may have far-reaching ramifications for factors more generally.
