The department regularly advises international financial institutions regarding regulatory compliance in the country, and the do’s and don’ts that foreign financial advisors must observe when promoting financial products of instruments in the country or to Guatemalan nationals. The department works closely with the insolvency practice and is involved in high profile cases related to recovery of assets for international banking and financial institutions.  Also advises in commercial lending, foreign loans, aviation lending, project finance and loan restructuring on a regular basis.

The firm have solved problems that encompass different subjects, such as the impact and asset management in corporate, financial, investment and real estate transactions, covering both local and international aspects; asset planning; administrative and court defense against objections and information requests made by the tax authorities; counseling on transfer pricing; and counseling and legal defense against objections in custom matters due to tariff classification, valuation rules, rules of origin, application of free trade treaties and other similar cases.

These activities have made the need for bankruptcy managers, receivers and liquidators to have a specialized legal practice in Latin America, which would include ample tracing and asset recovery capabilities, the fulfillment of loan rights and the search for redress and justice for the assets under their charge.
