The GrayRobinson Labor and Employment Section offers management, employment, and labor litigation experience throughout agency proceedings, litigation, and appeals for public and private sector clients. We advise clients in all areas of agency, state, and federal law, including Title VII and Florida Civil Rights Act; Fair Labor Standards Act; Equal Pay Act; Age Discrimination in Employment Act; Family and Medical Leave Act; Americans with Disabilities Act; Worker Adjustment and Retraining and Notification Act; public and private sector whistleblower litigation; equal employment opportunity charges and claims; preparing, enforcing, and defending restrictive covenants; immigration and I-9 compliance; and defense of employment at will and related contractual and tort claims. We advise clients on administrative actions and claims arising from local ordinances.
For union-free employers, we create approaches that help minimize the likelihood of employees successfully unionizing. These include conducting investigations, advice on pre-petition and protected activities, representation petitions before the NLRB, and trials and appeals of unfair labor practice charges. If unionization can't be avoided, we have experience successfully negotiating collective bargaining agreements and addressing grievances, including arbitrating contractual and disciplinary claims arising from collective bargaining agreements.
