Caldwell Cassady & Curry represents companies and individuals as plaintiffs and defendants in various business disputes and class action claims, including cases involving trade secret misappropriation, fiduciary duty allegations, and disputes involving company founders. In Grace v. Apple Inc., Caldwell Cassady & Curry represented a class of plaintiffs in the U.S. District Court for the Northern District of California when Apple allegedly chose to purposely break the popular FaceTime video chat feature included in iPhones and other Apple devices. After defeating Apple's multiple attempts to dismiss the case, Caldwell Cassady & Curry secured class certification for all California class plaintiffs. The litigation settled on favorable terms when the trial court denied Apple's pretrial motion for summary judgment. In Morley v. Square Inc., Caldwell Cassady & Curry represented Washington University in St. Louis professor Dr. Robert Morley, inventor of the famous Square credit card reader, in his claims against Square Inc. and fellow Square co-founders Jack Dorsey and Jim McKelvey. The litigation in the U.S. District Court for the Eastern District of Missouri included Dr. Morley's claims for patent infringement, breach of fiduciary duty, misappropriation of trade secrets, wrongful exclusion of Dr. Morley from the company, and related business torts. The parties reached a mutually agreeable settlement ahead of trial.
