Our project practice stands out for combining legal knowledge with a deep understating of the construction industry. We advise both owners and contractors as well as sponsors, developers, and consultants throughout all stages of the project. Our team is experienced in drafting and negotiating EPC, EPCM, BOT, BOO and BOOT contracts; as well as FIDIC (all books). Our experience also covers public-private partnerships, public works, government to government contracts (G2G) and private works.

Our dispute resolution practice is recognized as a relevant, key player, representing clients in complex, multi-claim arbitration procedures.Our clients acknowledge our attention to detail as well as our creative approach at devising tailor-made strategies. Our arbitration practice follows, and applies, the highest international arbitration standards. Even though our practice focuses on party representation; our partners are often appointed as expert witnesses or arbitrators. We are very familiar with the arbitral rules and provisions of the most renowned local and international arbitral institutions (such as Lima Chamber of Commerce, AMCHAM, ICC, ICSID, amongst other).

Main Areas of Practice: 

Arbitration & ADRs: 

The firm's dispute resolution practice focuses primarily on construction and commercial disputes; mainly through arbitration, both in domestic and international settings.We are also highly experienced in arbitration-related litigation. The firm is also actively involved in bilingual English-Spanish cases and often deals with third-party funding issues. The firm’s experience covers a wide range of disputes arising from public and private construction contracts and PPPs related to infrastructure projects.

The team has an outstanding legal and technical expertise in construction matters. Claims usually handled by the firm include extensions of time, cost overruns, variation orders, standby costs, force majeure, disruption, and constructive acceleration. The team also deals with contract and commercial claims such as contract termination, breach of contract and damages; with an impressive track-record. We have successfully negotiated over 50 contracts, presented over 40 claims to dispute resolution boards and represented clients in more than 300 national and international arbitrations, obtaining extensive experience in the design of effective and comprehensive legal strategies.

Projects: 

The firm's project practice focuses on project planning, negotiation and contractual negotiation and execution of contracts, as well as risk management, claim prevention and project closeout. Our firms extensive experience in the development, financing and execution of major projects is recognized in the infrastructure market.

The team advises owners and contractors in the development of private and public projects. On matters related to public projects, our team is familiar with several structures, such as public-private partnerships, works executed under government-to-government agreements (G2G), works-for-taxes and public works under traditional regimes. We are also experienced in the elaboration and advice on construction contracts, EPC, EPCM, ECM, BOT, BOOT and standardized models such as FIDIC and NEC. The firm usually handles projects dealing with civil infrastructure (roads, bridges, ports, airports and trains), education and health facilities, sports facilities, energy (generation and transmission), sanitation and sewage plants, irrigation, housing and commercial buildings, as well as oil, gas and mining facilities.

International Work: 

The firm advises international clients in highly complex cross-border transactions. The team's work is usually related to major projects under international contract models as FIDIC and NEC or governed by foreign law. Arbitration and ADRs expertise include international proceedings under ICC and UNCITRAL rules.
