Main Areas of Practice:
Real Estate
Real estate and developer representation is one of our greatest strengths and core practice areas. We represent buyers, sellers, lenders, developers, and institutions in all aspects of commercial and residential real estate transactions, from initial acquisition through development, and from construction to closings with buyers.
Financial Frauds
Our attorneys have represented trustees, receivers, creditor committees, creditor committee members and victims in some of the largest and most high-profile financial frauds and Ponzi schemes in South Florida. We have been appointed by state, federal and bankruptcy courts to serve as receiver, trustee and plan administrator and manage third party litigation. We have extensive experience litigating clawback, professional negligence, usury and tort claims. In particular, we have successfully prosecuted a number of cases against regional and national financial institutions for their role or complicity in a financial fraud case.
Commercial Litigation
We have extensive experience representing businesses and individuals in virtually all aspects of this area of the law, litigating cases in state and federal courts through trial. We represent clients in matters related to breaches of contract, financial frauds, intellectual property, insurance, secured transactions, business torts and related matters, often in bet-the-company circumstances.
Receiverships and Assignments
Whether serving as the court-appointed receiver, or as attorneys for the receiver, we know how to manage large and complex cases and understand how to maximize value for creditors. We have extensive experience handling all aspects of a receivership case and managing the state-court-supervised liquidation process.
Bankruptcy and Restructuring
Our firm represents key stakeholders in some of South Florida's most complex business reorganization cases, regularly representing corporate debtors, equity, and creditors, with a specific focus on retailer, healthcare, hotelier, and real estate developer clients.
Trade Secrets & IP
The firm handles a broad range of matters involving non-patent IP. The firm represents plaintiffs and defendants in trade-secret and restrictive-covenant litigation nationwide. Additionally, the firm has developed a unique trade-secrets audit, which involves identifying a company’s proprietary information, evaluating the way the company protects this information, and providing recommendations to better secure it. We also represent trademark and copyright owners in litigation to enforce their IP rights and defend companies and individuals against claims of infringement.
Creditors’ Rights
We regularly represent secured and unsecured creditors, banks, lending institutions and related entities, and court-appointed receivers and assignees for the benefit of creditors. We have substantial litigation experience in all types of creditors’ rights, UCC, and banking disputes.
Corporate
Our corporate attorneys offer a complete range of services to corporations, partnerships, individuals, and not-for-profit organizations. We are well-versed in all types of business transactions and their structuring and implementation.
Trial Practice
We have extensive experience trying cases, before both judges, juries, and arbitration panels. We build our litigation strategy around trial, ensuring that we obtain the evidence necessary for an effective trial presentation. While most civil cases settle, our deep trial experience, combined with our reputation for taking cases to trial, enables us to negotiate from an advantaged position.
