Van der Feltz advocaten is an independent boutique law firm based in The Hague, The Netherlands, with a strong focus on the markets of Construction & Real Estate, Government, Industry and Energy. The firm’s lawyers advise and litigate on both private law and public law matters (i.a. public law, including zoning and planning law, energy law, governmental liability, environmental (criminal) law, expropriation, real estate, infrastructure projects, tax law and Supreme Court litigation), often operating in the interface between these two. They have a deep understanding of how government operates and of the relevant interests of the governmental bodies involved. Clients range from the public sector (utility, water companies, local and regional authorities, (municipalities, provinces, environment agencies), to businesses active in:

Jacques Sluysmans, partner, has been a professor of expropriation law at Radboud University Nijmegen since 2013. ■ Representing the Province of South Holland and DCMR regarding various ex officio amendments of the permit of Chemours, the revision of this permit and several enforcement matters based on this permit
■ Representing a global pharmaceutical company regarding the development of a new site in The Netherlands
■ Advising Tata Steel regarding the emissions of dust and graphite, which are released during the handling of iron slags and have regularly spread to neighboring communities (Wijk aan Zee) and caused unrest under its inhabitants (‘graphite rain’)
■ Advising and litigating for a developing corporation, regarding the development of several large residential and commercial projects in the Netherlands

Energy & Natural Resources:
■ Advising companies, municipalities and provinces on the development of heat projects in the light of existing and upcoming heat legislation (tendering, obligation to connect, connection costs, soil energy legislation, state aid)
■ Advising developers of offshore wind energy projects on permits for the construction and operation of offshore wind farms
■ Advising on and litigating in onshore and offshore (test) drilling for natural gas for mining companies
■ Assisting energy companies, industry, and (decentralised) government in determining their strategy and future activities with a view to new energy legislation, such as the implementation of the Energy Transition Legislative Agenda, the Climate Agreement and the Environment Act
■ Advising on and litigating in extraction plans for the extraction of natural gas for mining companies

Real Estate:
■ Representation of the European Patent Office (EPO) on the development of its new main building, EUR 250m office building of 80.000 m2 for staff of the EPO (architect: Atelier Jean Nouvel), including related tenders regarding maintenance, consultancy, etc.
■ Representation of a large project development company regarding the development of a new residential area (1.200 houses)
■ Advising and representing a project developer a new 5* hotel in Amsterdam including 123 rooms and 23 short-stay units, offices etc.
■ Advising and litigating for municipalities in the greater Amsterdam-Rotterdam-Utrecht metropolitan area concerning relevant zoning plans and expropriation needed for the redevelopment of the greenhouse districts and for the development of a residential area of 3,400 homes
