David Langer is counsel in the Environment, Land & Resources Practice in the New York office. His practice involves advising clients on a broad spectrum of environmental aspects of corporate, real property, and financial transactions, including CERCLA, Clean Air Act, Clean Water Act, and Endangered Species Act, and related state and local laws, such as New Jersey's Industrial Site Recovery Act (ISRA). Significant transactional matters have included representations of sellers, purchasers, lenders, and underwriters in the context of asset and stock acquisitions, securities and high-yield debt offerings, commercial credit facilities, and project finance transactions. He has also been involved in negotiation of contracts for solid waste disposal services and electric power demand side management projects.
Mr. Langer's regulatory practice has involved permitting and compliance support for independent electric power plants and other industrial and commercial facilities, including waste oil recyclers; cement, pesticide, cosmetic, and paper manufacturers; and bus operators. He has experience in the federal Clean Air and Clean Water Acts and related state and local programs. Mr. Langer's Clean Air Act experience includes consultation on new source review (NSR, PSD, NSPS) issues for construction or modification of facilities, Acid Rain regulations, Regional Emission Trading programs, Title V applications, and air permit enforcement actions. His Clean Water Act experience includes representation of clients with respect to both permit applications and enforcement actions, compliance with storm water discharge regulations, and advising a municipal client on amendments to its sewer use ordinance.
Mr. Langer's litigation experience includes administrative enforcement actions relating to violations of air pollution control permits and regulations, building code standards, asbestos control programs, wastewater discharge standards, storm water permits, community right-to-know reporting obligations, and product safety standards. Other litigation matters have included cost recovery actions relating to leaking petroleum storage tanks, arbitration of disputes over solid waste contracts, challenges to local solid waste flow control ordinances, and commercial contract disputes. Mr. Langer has also represented an independent energy marketer in state utility commission proceedings relating to the deregulation of natural gas and electricity markets.
Mr. Langer has participated in pro bono representations of the Wildlife Conservation Society, the Hebrew Free Burial Association, and the South Brooklyn Local Development Corporation.
