Elizabeth Herrington, a partner and leader for the Chicago litigation practice, focuses her practice on complex commercial and class action litigation across the United States, including management of multijurisdictional investigations and litigation. She has successfully first-chaired jury and bench trials, as well as complex commercial arbitrations, across the United States. With more than 25 years of practice, she defends high-profile class actions and is one of the few lawyers who have tried two certified class actions. She is also on the firm’s global Advisory Board.

She handles litigation and counseling for some of the country’s top technology and ecommerce companies. She has received the Trailblazers Award from The National Law Journal and has been named a Law360 MVP for defending companies against high-profile, high-exposure privacy class actions on cutting-edge privacy and cybersecurity issues. Law Bulletin Publishing Company notes she is “a skilled attorney with the highest level of integrity” who “possesses an unusual ability to handle the multi-faceted aspects of complex litigation under difficult circumstances, while maintaining her focus and inspiring the confidence of her client.”

With experience in all aspects of corporate litigation, she advises clients on compliance with data privacy and cybersecurity requirements, such as the Illinois Biometric Information Privacy Act (BIPA), California Consumer Privacy Act (CCPA), Gramm-Leach Bliley Act (GLBA), Telephone Consumer Protection Act (TCPA), Fair Credit Reporting Act (FCRA), EU General Data Protection Regulation (GDPR), and state data breach notification laws. She also has experience with children’s online privacy issues and has worked with clients to comply with the Children’s Online Privacy Protection Act (COPPA) and numerous other state laws regarding privacy. She advises on privacy and security issues related to cutting-edge technologies including facial recognition, voice recognition, iris and retinal scanning, artificial intelligence and machine learning, ad tech, location tracking and employee monitoring, and blockchain.

She frequently speaks to corporate counsel about privacy and cybersecurity as well as privacy, litigation risk management, and alternative dispute resolution options.

She is a past president of the Seventh Circuit Bar Association and is an active member of the Chicago Inn of Court. She also sits on the boards of numerous charitable organizations.
