As Chair of our Congressional Investigations Practice and Co-Chair of our Government Controversies and Public Policy Litigation Practice, Emily M. Loeb leverages her deep government and crisis management experience to guide companies and institutions through multi-faceted investigations and congressional inquiries, often during times of intense media scrutiny. As a former Associate Deputy Attorney General at the US Department of Justice and a former Associate White House Counsel, she has extensive experience conducting internal investigations and devising holistic risk management strategies for clients. The National Law Journal profiled her as one of Washington, DC’s next generation of crisis management lawyers or “DC Fixers."

Emily rejoined Jenner & Block in 2022 after serving on the Biden Administration’s “Day One” leadership team at the Department of Justice. In that role, she advised the Attorney General, the Deputy Attorney General, and other senior Department of Justice leadership on matters relating to Congress, including preparing Department nominees and officials for congressional hearings. Emily was responsible for overseeing the DOJ’s responses to congressional oversight and investigations, including managing parallel executive privilege and separation-of-powers litigation, and she was often tasked with leading efforts to address complex intra-agency policy and compliance issues. She also supervised engagement with the Government Accountability Office (GAO) and the DOJ’s Office of Information Policy, which coordinates Freedom of Information Act (FOIA) policy for the Executive Branch.

Emily’s practice focuses on representing high-profile clients facing challenges at the intersection of litigation, law enforcement, regulator and congressional investigations, and public scrutiny. She leads internal investigations and manages responses to congressional oversight, including preparing senior executives to give congressional testimony, to assist clients in strategically managing related risks from civil litigation, criminal investigations, and business reputation threats.

Prior to joining Jenner & Block in 2016, Emily served for more than six years in senior positions in the Executive Branch. As an Associate Counsel in the Office of the White House Counsel, she advised senior White House and Executive Branch agency officials on high-priority litigation and congressional and other investigations, managing risk on a variety of policy initiatives. Before joining the Office of the White House Counsel, Emily served in several roles at the DOJ, including Senior Counselor and Acting Chief of Staff of the Civil Rights Division. During her time in the Civil Rights Division, she directed its response to congressional oversight and inspector general investigations and oversaw its legislative and policy initiatives. In 2012, Emily served as a special assistant US attorney in the Eastern District of Virginia, where she prosecuted federal drug and wire fraud cases. From 2009 to 2010, she was legislative and policy counsel in the White House Office of Legislative Affairs, where she helped enact the Healthy, Hunger-Free Kids Act of 2010 and student loan reform in the Healthcare and Education Reconciliation Act of 2010.
