Career
Chair of the firm’s Patent Prosecution Center in Utah, Kevin advises businesses of all sizes across the country - from Silicon Valley to the Silicon Slopes to the East Coast - on all aspects of patent strategy, including preparation of patent applications; prosecution; and commercialization of patents, patent families, and patent portfolios. With thousands of patents successfully filed and granted over the course of his career, Kevin delivers a demonstrable breadth of experience and know-how in a variety of complex technological areas.
Whether managing the patent portfolio of a Fortune 500 company or a startup, Kevin is valued for his ability to ask the right questions, resulting in a smooth filing process and a compelling patent application.
Kevin is dedicated to knowing every detail about his client’s innovation, including its unique features and commercial viability. He focuses on procuring patents for developments that support business goals and future product development efforts. A direct and effective communicator, Kevin is able to articulate even the most sophisticated concepts in a manner that can be understood by inventors, founders, owners, presidents, CEOs, and in-house counsel alike. Notably, he is consistently successful in working productively with patent examiners and in writing claims that not only avoid prior art but also protect the client’s product and allow for some degree of flexibility.
Kevin is valued for his deep knowledge of patent eligibility (commonly referred to as Alice rejections or § 101 rejections [35 USC § 101]) and the significant changes enacted under the America Invents Act. As a result, he is frequently called upon to provide continuing legal education presentations to clients and to colleagues within the firm.
Kevin’s patent prosecution skill is informed by a background in electrical and computer engineering. He stays abreast of the latest developments in mobile device wireless technology, cloud-computing services, bendable sensor technology, wearable devices, Internet of Things (IoT) technology, touch-screen technology, mobile device antennas, microprocessors, memory technologies, medical devices, video streaming, and smart television technology. With each advance, he relishes taking on new and challenging technologies and their resulting legal complexities.
A professional who seeks to understand each client’s organizational imperatives, Kevin cares deeply about the individuals and businesses he serves. He takes the time to build productive relationships grounded in trust and practical legal and business solutions. Committed to the development of the greater tech community at large, Kevin actively participates in VentureCapital.org, serving as a mentor to an array of emerging companies. He is a Master in the David K. Winder Intellectual Property American Inn of Court, where he interacts with industry judges and counselors to discuss critical information designed to nurture development and creativity.
