Career

For 30+ years, Michelle Fischer has tried, litigated and provided trusted, practical counsel on a broad spectrum of antitrust issues involving industries like auto parts, gasoline, distribution, food products and pharmaceuticals. Recently, Michelle played a lead role in obtaining dismissal on FTAIA and forum non conveniens grounds of a complaint alleging both a conspiracy to boycott an auto parts supplier and monopsonization, and in twice obtaining dismissal of a case involving medical supplies, first of a hub-and-spoke antitrust conspiracy claim, and then of vertical antitrust conspiracy claims (affirmed on appeal), including for lack of standing. Michelle also was among the lead trial lawyers who defeated price discrimination claims against a cigarette maker, and generic drug delay (class) claims against a drug manufacturer. She is currently handling cases involving, e.g., alleged Walker Process fraud, alleged conspiracies in the financial instruments and beef industries, and alleged monopolization based on purportedly improper Orange Book patent listings. Michelle also has extensive experience in governmental investigations, and issues involving price-fixing, price discrimination, monopolization, IP, and more. She co-coordinates Jones Day's practice applying antitrust law to IP issues, routinely counsels on Robinson-Patman and price gouging issues, and twice chaired the Ohio State Bar Association's Antitrust Section.
