Patrick Essiminy is a partner and Head of the Montréal office’s Employment & Labour Group and a member of the Montréal Office's Management Committee.
Among his clients he is known for his strategic and practical advice, and for a practice style that is both effective and oriented to business priorities.
Patrick practices in all areas of employment and labour law, for both provincially and federally regulated companies.
More specifically, he represents his clients before the Québec labour tribunals, particularly before the arbitration tribunal and the Tribunal administratif du travail. He also represents clients in the civil courts, including the Superior Court and the Quebec Court of Appeal, in connection with unjust dismissals, injunctive relief, judicial review and any other matter related to employment and labour law.
Patrick has considerable experience in workplace health and safety matters, making him an expert who is recognized both by his peers and Canadian employers in both provincial and federal jurisdictions.
In addition, he advises employers on union certification matters and regularly acts as an employer spokesperson in collective bargaining.
He also has particular expertise in:
Interpretation and application of the Charter of the French Language, which applies to companies operating in Quebec; Human Rights; Employment Standards; Files related to harassment and discrimination in the workplace; disputes involving employees/shareholders.
In addition, he is the editor of the Stikeman Elliott Employment & Labour Law blog and is frequently invited to speak at various seminars.
