Main Areas of Practice: Corporate/M&A:  

Fylgia frequently assists its clients in national and international mergers and acquisitions. IT & Intellectual Property:  

IT-related law, copyright law, trademark rights and other intellectual property law are key areas for many businesses. This is also the case for many of Fylgia’s lawyers. There are a number of lawyers at Fylgia with many years of experience of advising clients in these areas of the law, not only as outside counsel but also as in-house counsel as well as local counsel to multinational corporations.

Insolvency:  

Fylgia has one of the largest insolvency departments in Sweden. There are thirteen bankruptcy administrators, seven lawyers as well as approximately ten employees who take care of the administrative aspects of bankruptcies. Fylgia has dealt with many large and complicated bankruptcies in recent years. The lawyers at the insolvency department also act as administrators in reconstructions and as liquidators in liquidations on behalf of the Swedish Companies Registration Office.

Dispute Resolution:  

Many of Fylgia’s lawyers are experienced and expert litigation lawyers, who guide the client through the often time-consuming and stressful situation of being a party in a dispute. The aim is to find the most advantageous commercial solution for the client, which may entail attempts to resolve the matter outside court (settlement). If this is not possible, the firm represents the client in court or at an arbitration tribunal. Together with the client, Fylgia plans a strategy to achieve the goal. The firm’s procedural lawyers have expertise in a large number of industries and experiences from most areas of law.

Public Procurement:  

In Sweden central government, county councils and municipalities, together with other procuring authorities, purchase goods and services for around SEK 500 billion a year, which corresponds to around 20 per cent of GDP. Purchases by procuring authorities and departments are now primarily regulated by three laws: The Public Procurement Act, The Water, Energy, Transport and Postal Services Procurement Act and The Defence and Security Procurement Act. These laws are based on EU directives. Health care and social services are also subject to the Freedom of Choice (Systems) Act. The rules on procurement include provisions on revision, damages and other legal remedies. The regulatory framework relating to procurement is often regarded as being difficult. This is not least due to frequent changes in the rules. Furthermore, continuous clarifications of the application of the rules are made through court decisions, where, of course, the judgments of the European Court are particularly important. Fylgia’s experts on public procurement have considerable experience of the issues pertinent to procurement. The firm assists both procuring authorities, units and suppliers and those submitting tenders, both before and during the procurement procedure, as well as in court cases involving revision and damages.
