KINSHIP was founded in November 2021 in order to focus exclusively on international private clients with complex structures and offer an industry approach (i.e. combining international tax with other fields of the law such as international estate planning, direct investing, international family law and immigration). The team is now comprised by 11 fee-earners. As an international law firm based in Spain (Madrid and Marbella), KINSHIP is focused exclusively on international private client matters; its clients include multi-jurisdictional individuals, families and their advisors, as well as private businesses and institutions.
- Tax planning and protection: Kinship's Tax team offers services in Spanish tax law, international tax law and European Union tax law. Our technical expertise, combined with experience in interacting with foreign national tax regulations, allow us to provide our clients with strategic advice and coordinated solutions for those tax issues that arise as a consequence of their increased international exposure.
- Direct Investing: we advise our clients on the acquisition and disposal of real estate and corporate assets. Helping private companies find optimal corporate structures is one of our most requested advisory functions. We also advise in connection with the design of business operations, execution of transactions and business reorganizations involving third parties, as well as inter generational leadership changes in the family.
- Estate Planning: Families need certainty in the multi-jurisdictional situations arising from the transfer of wealth between generations. We therefore provide practical and strategic international advice on inheritance and succession planning, including assistance and coordination in the preparation of wills, trusts, will-substitutes, and trust-like institutions. In addition, we provide solutions, in coordination with the area of tax law, for all issues that may arise in cross-border successions. In the area of succession and inheritance law, we assist beneficiaries and heirs, as well as executors, trustees, and other fiduciaries in the various stages of the probate process, as well as in the multi-jurisdictional administration of estate assets, preserving the estate’s interests until the final distribution to the beneficiaries designated by the testator. Elderly and vulnerable people are also part of our focus. We protect their assets through “lasting powers of attorney” in Common Law jurisdictions, and “preventive powers” in Civil Law jurisdictions, entrusting representatives with decision-making powers over personal and/or financial interests, thus avoiding the need for the judicial appointment of deputies.
- Family law: Preventive estate planning must always consider the implications resulting from the differences between Common Law and Civil Law jurisdictions regarding matrimonial property and the effects of divorce on family assets. We therefore try to offer preventive solutions to international couples by means of prenuptial agreements and marriage contracts. We also provide advice on international divorce, both non-contentious and contentious, aimed at cross-border protection of family assets throughout the divorce process. The choice of jurisdiction and applicable law can have a major impact on the preservation of family assets in these cases.
- International mobility: Within the international mobility domain, we offer support services to various departments within the firm, specifically focusing on visas, residence and work permits, and nationality acquisition. Our objective is to facilitate a seamless and stress-free immigration process for our clients. In doing so, we extend our services to high-net-worth individuals and their families, providing practical and customized solutions. These solutions integrate comprehensive immigration strategies, always mindful of family planning considerations. Additionally, we assist our clients’ companies in securing visas and permits for their senior executives, especially when seeking to expand their business operations in Spain. Furthermore, we coordinate expatriation processes in the internationalization of Spanish companies.
