Representative Matters 

-The firm represents the New York City Housing Authority (NYCHA) in connection with NYCHA's ambitious project, with a private developer partner, involving the long term lease of NYCHA property to allow for the redevelopment of 2,500 existing NYCHA residential units and the development of up to additional new 2,000 affordable and market rate units on two NYCHA campuses in the Chelsea neighborhood of Manhattan. The firm advises on the environmental review associated with the redevelopment project under NEPA, SEQRA and CEQR.

-The firm represents a not-for-profit land trust subsidiary in connection with the planning, approvals and development of a $150 million 7.2-mile shoreline park extending from Beacon to Cold Spring, New York, which will be constructed on property owned by New York State, New York City and various municipalities. The firm's role includes negotiation of the real property interests needed to construct the park, various contracts with contractors for the project, and environmental review and permitting advice. The firm also provides zoning and land use advice and is pursuing entitlements in connection with the development of the office space for the not-for-profit and as well as a visitor center for park users.

-The firm represents EPR Properties, a publicly traded real estate investment trust. The firm's attorneys obtained discretionary land use approvals and environmental permits for and successfully defended EPR against a SEQRA challenge to EPR's $4 billion, 1,700-acre mixed-use project in Sullivan County including hotels, a casino, recreation areas, open space, a waterpark and a golf course, together with $100 million of new infrastructure. The firm's attorneys drafted and negotiated the project's master development agreement, master declaration of covenants, easements and restrictions, ground leases, and guarantees. The firm provides ongoing advice to EPR regarding the project's governing documents, resort operations and coordination with local officials. The firm also handles zoning matters at EPR's entertainment retail center in Westchester County, pursuing zoning code amendments to allow for new uses, and also advising on leasing and landlord/tenant issues.

-The firm provides ongoing environmental advice to GMD Shipyard, Inc., an active historic shipyard in the Brooklyn Navy Yard. The firm negotiates the environmental provisions of the shipyard’s long-term lease of land, dry docks and piers from the City of New York. The firm regularly coordinate with GMD’s consultants to mitigate environmental risk arising from operations. The firm also advises the shipyard in connection with environmental compliance and environmental permitting, including under the Clean Water Act, the Clean Air Act, and solid waste requirements.
