Work Highlights
1. In December 2022, the Case Law Research Association of the China Law Society and the Guangdong High People’s Court jointly released the fifth batch of typical cases on cross-border disputes in the Guangdong-Hong Kong-Macau Greater Bay Area. Among them, a series of cases involving a property sales contract dispute between Tak Ah International Limited and Mr. MAI was selected, with attorney Chenhui LI representing the Tak Ah.
In this series of cases, the legal opinions presented by attorney Chenhui LI’s team, acting as the representative for defendant Mr. MAI, were adopted and confirmed by the Guangzhou Intermediate People’s Court in its final judgment.
The China Law Society and the Guangdong High People’s Court believed that this case had positive significance in terms of determining the impact of litigants’ actions in Hong Kong courts on the statute of limitations for litigation in mainland China. The case effectively bridged the litigation rules between the Chinese Mainland and Hong Kong, promoting the lawful exercise of civil rights by the parties involved.
2.As one of the three major grid-level data centers in the overall layout of the data center, of China Southern Power Grid Company, the Southern Energy Big Data Center is positioned as the production data center and remote disaster recovery center of the power system. It will provide energy digital services for the whole society after completion.The first phase of the Southern Energy Big Data Center project is scheduled to be put into operation in 2024, which can provide 2,000 10-kilowatt cabinets with service capacity. It will provide strong support for the digital transformation and upgrading of the Southern Power Grid Company, and meet the medium and long-term computing power and data centralized storage needs of the digitalization of the company's regulated and non-regulated businesses.The project is located in Guizhou province, and the client is a local enterprise in Guangzhou. Lawyer Li Chenhui and his team have conducted field visits to the project site several times, and assisted the client for depth negotiations with the local government, in order to strive for greater interests and ensure the smooth development of the client's project.
3. In 2021, the National Electricity Coordinator Board of Chile held the award ceremony for Chile’s first high-voltage direct current transmission project, the Kimal-Lo Aguirre HVDC project. This project was invested in by China Southern Power Grid Co., Ltd. (CSG) and was jointly developed and operated by a consortium composed of China Southern Power Grid International Co., Ltd., Chile’s Transelec, and Colombia’s ISA. As the special legal advisor for China Southern Power Grid’s (CSG) overseas projects, Dentons Guangzhou office conducted a review of the legal compliance and legitimacy of CSG International’s participation in the bidding for the Chile Kimal HVDC Greenfield Investment Project and related matters. Dentons Guangzhou office, led by attorney Chenhui LI, provided legal services to CSG’s headquarters in accordance with the regulations of the Central Enterprise Overseas Investment Supervision and Management Measures, and assisted CSG in making decisions regarding this significant overseas investment project, taking into consideration the organic integration of transmission and transformation business with overseas investment projects and providing legal risk advice for the project.
4. Attorney Chenhui LI’s team provided specialized legal services for a certain non-ferrous metal company’s acquisition of 51% equity of a mining company, with a project value exceeding CNY 600 million. The mining company, which was the target of the acquisition, was established in 1958 and started production in 1966. It had a long history with complex asset conditions, involving the disposal of "three supplies and one industry" as well as the placement of employees with different identities. This project attempted to rectify the legal compliance issues in dealing with the difficulties of past state-owned enterprise reforms, guiding well-established state-owned enterprises towards the path of asset securitization.
5. Attorney Chenhui LI’s team provided comprehensive legal services for the construction project of Guangdong Power Grid Production Dispatching Center of Guangdong Power Grid Co., Ltd. The project consisted of four power production buildings with a total construction area of 163,460 square meters and a total investment of CNY 2.28 billion. Before hiring specialized legal advisors, the project had been in progress for over a year. Due to inadequate handling of contract signing and specific performance with the construction party, the project’s timeline was repeatedly delayed, and there was a risk of completed constructions becoming unusable and requiring extensive rework due to prolonged stoppage.
Upon successfully winning the bid for this project, attorney Chenhui LI’s team immediately engaged in the project and identified existing issues during the early stages. They actively assisted the client in communicating, negotiating, and reaching agreements with the construction party, taking effective measures to prevent further losses. During this process, the team carefully reviewed the correspondence between the client and the construction party, helping the client clarify responsibilities among all parties involved and effectively reducing compliance risks for the client as a large state-owned enterprise.
6. Attorney Chenhui LI’s team represented UOB (China) Limited Guangzhou Branch in a financial loan contract dispute case against Tai Ao Aluminum (Taishan) Co., Ltd., Ho Sheung Ping, and Tai Ao Aluminum Group Co., Ltd. The team successfully achieved a comprehensive victory for the client, UOB (China) Limited Guangzhou Branch, resulting in the recovery of approximately CNY 100 million in principal and interest.
