Work Highlights
Litigation and Non-Litigation of Shipping Legal Practice:
•Represented shipowners of M/V “Bigswan” in her collision with M/V “Qiang Shun 8”, involving such issues as ship collision, salvage of sunken ship, marine pollution, maritime administration, and carriage of cargo, as well as various legal procedures such as maritime investigation, limitation of liability, maritime security, maritime litigation, compulsory enforcement, and so forth. Darong’s opinion was supported by the Court
•Broke the shipowners’ limitation of liability on behalf of the cargo interests in the case of fire accident and sinking of M/V “Hua Ding Shan”, which is a precedent where the interpleader action went into normal proceedings and the shipowners’ entitlement to limit liability was negated.
• Represented a P&I club in a litigation over P&I insurance contract related to M/V “Yun Hong”, which was the first case in China involving a jurisdiction dispute related to P&I insurance contracts.
• Achieved a favorable result for the Charterers in the case of arresting the ship bunkers on board M.V. “TE HO”, which is the first case related to arresting the foreign ship bunkers in China. Mr. Wang creatively put forward the scheme of "oil detention on board", and successfully reached a three-party settlement with the Applicant and the Shipowner on behalf of his client.
• Represented some foreign shipowners involving a serial of cargo claim cases arising from containers’ falling overboard M.V. “CMA CGM OTELLO” and “CMA CGM G.WASHINGTON” respectively before 5 different maritime courts of PRC. The court attached great importance to the defenses of Mr. Wang, which resulted in a favorable settlement and mitigated the losses of his client to the maximum extent.
• Represented a large state-owned enterprises located in Xiamen in handling cargo (DDGS) claims against the shipowners (a shipowner in Marshall Islands and a shipowner in Sweden respectively) after various and complicated legal procedures in both China and Britain, such as the anti-suit injunction and the LMAA arbitration in Britain, the legal proceedings on substantial trials, and an application for recognition/enforcement of arbitral award before the Chinese court where Darong employed an innovative approach in refuting such an application, acquiring a satisfactory compensation for the client in the end.
• Represented a foreign-invested shipyard in Jiangsu Province and its affiliated Hongkong companies (“Owners) in a series of disputes over bareboat charters regarding a series of vessel M.V. "Welhero", M.V. “Welproft”, M.V. ”Welfine" and M.V. “Weltrust" between the Owners and the guarantees (“Charterers”, four shipping companies based on Hongkong). Darong helped client successfully obtaining a huge compensation from the maritime guarantors at last.
• Advised and/or represented shipowners or charterers in many arbitration cases regarding charterparties before LMAA in London or HKIAC in HK. For example, in the M.V. “Baochanghai” Charter Party Dispute Case arbitrated in LMAA, Mr. Wang represented the shipowners and won an overwhelming victory which awarding over RMB 60 million. Thereafter, Mr. Wang further represented the shipowners to apply for recognition and enforcement of this LMAA award against the Charterers, a large state-owned enterprise group, in Wuhan Maritime Court in accordance with the New York Convention and finally the all losses of the client were recovered.
Legal Advice and Paper Works in Transitions of Ships:
• Provided legal services re shipbuilding contract and financing contract for a shipping company in Xiamen in the whole process of building two 57000 tons bulk vessels;
• Acted as permanent legal advisor for a cruise company to provide legal services for negotiation of cruise design and construction contracts;
