Duncan has a well-established and diverse practice, with particular expertise in energy and sectoral regulation, renewable projects and climate change legislation, planning issues/disputes, procurement and competition law, and commercial or other contractual disputes (in particular those involving a regulated sector). He is known for his ability to handle complex disputes and to navigate complex legislative or other legal/regulatory frameworks. His work combines non-contentious advisory work, representations before regulatory/decision making bodies, CAT litigation, and High Court litigation including in particular Judicial Reviews and cases in the TCC or contractual and other disputes in the King's Dench Division (including cases then considered by the appellate courts).

Career

Duncan has been a Barrister at 39 Essex Chambers for some 14 years. After an initial period of practice at the bar, Duncan worked in London and Brussels in 2 leading law firms in their competition and regulatory departments; he was the lead lawyer on the Private Schools Investigation (for the School that was at the 'hub'), for Bacardi (abuse of dominance), on several UK and EU phase II mergers, 3 Market investigations (including in relation to vitamins, LPG and the banking sector) and a number of disputes and investigations concerning the interaction of IP and competition law. Having worked in the energy and telecoms sectors, he then took up the position as joint Head of Legal at Ofgem for just over 5 years (2005-2010) before returning to private practice at the bar in 2010.
