Career

Henry J. Jaffe is a partner in the firm’s Bankruptcy, Restructuring & Creditors’ Rights practice. He represents debtors, trustees, and creditors’ committees; secured, unsecured, and administrative claimants; and receivers in federal and state receivership actions. He has helped numerous creditors as first chair counsel in a broad array of industries both improve their recoveries in bankruptcy cases and either eliminate or greatly reduce their risks. Henry has defended and prosecuted hundreds of avoidance actions in various jurisdictions throughout the U.S. (including cases where the amounts in controversy exceeded $100 million) and has assisted creditors with the assumption and renegotiation of complex executory contracts and leases. He has also helped numerous clients (including owners, contractors, and suppliers) in the construction industry with insolvency and bankruptcy issues. In addition, Henry has counseled both buyers and sellers of assets in bankruptcy, including sales involving intellectual property, pharmaceutical assets, and other assets. Henry has also counseled, among others, large retailers, manufacturers, distributors, landlords, large equipment lessors, and parties in the petroleum and plastics industries on their bankruptcy and insolvency issues.

Henry is a frequent writer and lecturer on various bankruptcy subjects and has been rated by Chambers USA for bankruptcy in Delaware since 2018. Since 2003, he has regularly authored or co-authored the article covering recent case developments under Section 547 of the Bankruptcy Code (preferences) for Norton’s Annual Survey of Bankruptcy Law. He has also published feature articles in Law360 and authored the chapter on Delaware state court receiverships in the treatise Strategic Alternatives For and Against Distressed Businesses.

Henry has lectured on bankruptcy topics and written materials for the American Conference of Bankruptcy Judges’ annual meeting, the American Bankruptcy Institute’s Construction Law Subcommittee, and the Pennsylvania Bar Institute. He has been an author and lecturer for continuing legal education provider, The Knowledge Group — presenting on various issues of interest to creditors and parties in bankruptcy cases. In addition, he has prepared extensive bankruptcy materials for the Eastern District of Pennsylvania Bankruptcy Conference and the Delaware Bankruptcy Inn of Court, for which he has served as a Bench Member and appeared as a panelist.
