Kerry Bretherton KC is an outstanding silk in the field of property and property development. She has acted in the Supreme Court and Court of Appeal in a number of the leading property cases. Described by clients as “ferociously tenacious” and “excellent on her feet” she is also known as “Fantastic to work with nothing is too much trouble and her response times are amazing”. Her clients include developers, freeholders, leaseholders and central and local government.

An expert in the Building Safety Act 2022 Kerry was involved in early key cases under the legislation, is currently acting in a number of high value disputes and has lectured extensively on it. Her work covers all elements of litigation and advice arising under the BSA which forms a substantial part of her practice. Kerry contributed to “The Building Safety Act” by Dovar and Sawtell due to be published later in 2024.

Kerry has substantial experience in cases involving options and overage, freehold covenants, restrictive covenants, easements, land registration, commercial and residential landlord and tenant, conveyancing disputes, mortgages, nuisance, public rights of way, and trusts, Kerry is co-author of “The Electronic Communications Code: A Practical Guide” the 2nd edition is due for publication in May 2023 and a contributor to “Service Charges and Management 5th Edition”.

An increasing element of Kerry’s practice are commercial disputes often those arising out of development or property transactions, construction and associated professional negligence. Typically, her work involves high value and complex disputes.
