Energy Litigation Highlights:
- Subsurface Trespass Litigation:Represented El Dorado Gas & Oil in a jury trial in McMullen County, Texas. Brought claims against affiliates of Energy Transfer based on damages caused by the companies’ underground storage of acid gas. After a two-week trial, secured more than $17,000,000 for El Dorado based on trespass claim.
- Energy Arbitrations:Represented Fortune 500 oil and gas operator in a contractual dispute with major oilfield services company. Sought millions in damages and defended against eight-figure counterclaims. Following a six-day final hearing, obtained unanimous order from panel in favor of operator and later secured settlement for more than the original damages sought.
- Energy Contract Litigation:Represented oil and gas operator in a breach-of-contract and fraud lawsuit filed against it by a leading seismic data provider. Data provider sought seven-figure damages based on an alleged violation of the parties’ agreement related to operator’s drilling of Eagle Ford wells. Secured complete win for client by summary judgment order dismissing all claims.
- Lease Ownership Litigation:Represented Marathon Oil in a quiet title suit in New Mexico against Chisholm Energy related to the ownership of valuable working interest rights in the Delaware Basin. The Court awarded Marathon ownership of the interests at issue, which were worth millions of dollars. Successfully defended against interlocutory appeal attempt at New Mexico Court of Appeals and New Mexico Supreme Court.
