Energy

Concept-to-closure advice is provided on energy projects, transactions, and assets. LNP Beyond Legal help clients navigate the complicated energy regimes within Sub-Saharan Africa. Risks associated with energy projects are identified, allocated and minimised.

Natural Resources

LNP Beyond Legal advises clients across the full lifecycle of mining projects; acquisition, financing, expansion, and disposal of mining assets. Infrastructure

LNP Beyond Legal advises on all aspects of local and international infrastructure projects. Roads to rail to ports, they provide support through the entire project lifecycle on both local and international projects in Sub-Saharan Africa advising government, contractors and investors on strategy and risk.

Recently, LnP Beyond Legal advised the National Transmission Company of South Africa (NTCSA) on the legal and commercial close of South Africa's first two private utility-scale battery energy storage projects. These projects, part of Round 1 of the Energy Storage Independent Power Producers Procurement Programme (ESIPPPP), mark several firsts for South Africa:

• first utility-scale battery storage programme in South Africa;
• first standalone, grid-scale, private sector battery projects;
• first deployment of specialised battery storage technology on a grid scale;
• first transaction under the programme closed by NTCSA as the Buyer under the Power Purchase Agreements (PPAs); and
• the first transaction signed off by the new Ministry of Electricity and Energy

With a combined capacity of 180 MW/720 MWh and a total investment of ZAR5.3 billion, these projects will store energy during low-demand periods and release it during peak demand, offering an innovative solution to South Africa’s energy crisis.

LNP Beyond Legal recently advised GED Africa on the US$200 million Kasomeno-Mwenda Toll Road Project from the DRC to Zambia. The team excelled in legal expertise, innovation, project management, and teamwork, managing the 2017 FIDIC White Book, 1999 Red Book, Umbrella Agreements, Framework Agreements, negotiations, task orders, and project templates. Initially project-financed, the project shifted to sponsor funding five months before contract signing, removing the security of an EPC arrangement. LNP Beyond Legal proposed innovative measures to manage risks across three jurisdictions with a Chinese contractor. Additionally, they created templates for the Engineer to coordinate programming, site risks, and interface points.

The team recently won The Winner Award at the FIDIC User Awards 2024 for their outstanding and innovative work on this project.
