O Since its foundation, Marins Bertoldi's civil litigation department has been focused on the defense of its clients' rights in business disputes before courts, arbitration courts, administrative authorities, and regulatory agencies. Headed by founding partner Marcelo Bertoldi, who led the first controlling shareholder expulsion from a ‘S/A’ corporation (the expulsion of Parmalat from Batavia), the department is well known for its technical and creative capacity in the resolution of highly complex corporate disputes.

Our Tax Litigation department demonstrates excellence in the customized handling of highly complex cases, such as defending our clients in substantial tax audits involving ICMS, ITCMD, IRPJ, CSLL, PIS, and COFINS, as well as cases related to goodwill and tax planning. In these scenarios, we strategically think through and develop the process to better meet each client’s needs, avoiding overly standardized solutions. Additionally, we have a leading role in administrative and judicial processes concerning the tax reclassification of goods intended for or originating from international trade, aiming to find the best legislative fit and consequently the greatest tax savings for each of these companies, tailored to the specifics of our clients’ products.

With a base of approximately 190 active clients, the firm assists relevant companies from several sectors, especially retail, industrial, civil construction, real estate, agribusiness, and energy, defending their interests in cases involving highly complex matters in the most diverse corporate matters. We are also experts in working with the Nonprofit Sector, providing legal counsel to charitable organizations for the recognition of tax immunity, especially in adopting procedures, including those involving the Ministries of Health, Education, and Citizenship, necessary for the granting of CEBAS and other certifications.

In the last two years, the litigation department has experienced a relevant growth, doubling the number of lawyers, as a consequence of the firm's growth, which follows an expansion project in the countryside of the state of Paraná and Santa Catarina.
