Jessica joined JunHe in 2013 and currently practices at our Beijing office. Jessica worked at CCPIT Patent and Trademark Law Office during 1997-2013 and was the deputy director of the Trademark Division. As a trademark attorney, she has handled thousands of IP cases and has extensive experience in the area of IP litigation, enforcement , prosecution and strategy, and possesses good understanding of Chinese laws relating to trademark, copyright and anti-unfair competition. Jessica’s clients hail from motor manufacturing sectors, hotel, apparel, luxury goods, technology, food and beverages, charity funds and organizations, retail and healthcare companies.

Jessica is adept at handling complicated trademark cases and has successfully assisted clients in obtaining recognition of well-known trademarks by the trademark authorities and the court, including BMW, JEEP, BUICK, Mary Kay, Chimelong, etc. Some of the influential cases she handled were widely reported by a variety of media including CCTV.

Cases handled by Jessica has been ranked as Top 10 IP Cases by the Supreme Court, Top 10 IP Cases by Guangdong High Court, and Top 20 Appeal Cases by the China Trademark Review and Adjudication Board. Some Appeal and Invalidation cases handled by Jessica have been ranked as Representative Cases by China Trademark Association and All China Lawyers Association, while some cases have been selected as Typical IP cases by WIPO, Outstanding Foreign-related IP cases by All China Lawyers Association, or Beijing Lawyers Association.

Work Highlights

1. Represented a Chinese company Zhen’ai Wang in retrial case for the trademark infringement of a famous TV show, “Fei Cheng Wu Rao” before Guangdong Higher People's Court and obtained favorable judgment. This case has been ranked as one of the Top 10 IP cases in 2016 by the Supreme Court and Guangdong Higher Court. This case was also included as representative case in WIPO Collection of Leading Judgments on Intellectual Property Rights People’s Republic of China (2011-2018).

2. Represented the world-renowned vehicle manufacturer BMW AG in appeal on refusal of their sound mark and received favorable official decision. The sound mark finally gets registered. This case has been awarded as one of best trademark prosecution cases by China Trademark Association in 2017~2018.

3. Represented one of the biggest theme park and hotel clients, CHIMELONG, to successfully recognize their “CHIMELONG in Chinese” marks as well-known marks in a series of trademark invalidation cases, which were selected as one of best trademark prosecution cases by China Trademark Association in 2018~2019.

4. Represented Italian luxury Mosaics company SICIS S.r.l. in a serial copyright infringement lawsuits and received favorable judgments. This series cases have been elected as Outstanding Foreign Related Typical Cases by Beijing Lawyers Association in 2021.

5. Represented a US beer brewing company, BELCHING BEAVER BREWERY, INC, in filing an opposition against a bad faith application and received favorable decision in which the client’s rights has been protected based on prior copyright. This case has been ranked as Representative cases by the IP Committee of ALL China Lawyers Association in 2023.

6. Represented a famous domestic jewelry manufacturer in filing retrial against unfavorable judgment of second instance issued by Beijing High Court and finally received favorable judgment issued by Supreme Court, which has saved great loss for client and has set a typical landmark case in the field of co-existence of time-honored brands.

7. Represented BMW AG in handling whole trademark portfolio and successfully helped client in recognition BMW series marks as well-known marks in administrative cases and litigations before different levels of Courts.

8. Represented the famous Norwegian company NORSK HYDRO ASA in trademark prosecution cases and civil litigation against a Chinese company in Aluminium Building Industry and all received favorable judgments, in which Beijing IP Court, Shanghai IP Court, Beijing High Court have confirmed the client’s high fame in the industry and granted protection of the client’s marks. In the civil litigation, 5 times of punitive compensation are applied which is quite rare in IP infringement cases.
