Career

Daniel M. Goldberg is Chair of the Data Strategy, Privacy & Security Group and Co-Chair of the Advertising Technology Group. He is consistently recognized as one of the nation’s leading data lawyers, and uses his considerable experience to help companies navigate legal compliance obligations relating to their data initiatives.

Daniel specializes in all matters involving data – from collection and monetization to storage and security. He has deep experience in the application of privacy and data security laws to consumer and HR datasets, including under the Federal Trade Commission Act (FTC Act), WPA-style state laws (Colorado, Connecticut, Delaware, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Virginia, and Utah), and sectoral laws (such as Washington’s My Health My Data Act). Based in Los Angeles, Daniel is considered a thought leader in California privacy law, specifically the California Privacy Rights Act (CPRA) and the Age-Appropriate Design Code (AADC), effective July 2024.

Daniel not only reads data laws, he is instrumental in shaping their application. He is a frequent speaker and writer, and has worked with business leaders, regulators, and self-regulatory bodies to interpret and address obligations under these laws. Daniel often works in a strategic role of advising companies on the development of data governance frameworks. In this role, Daniel collaborates with various stakeholders (including C-suite, legal, sales, marketing, and IT) to evaluate data flows, assess and mitigate risks that arise from proposed projects and products, and harmonize programs and policies to address obligations across jurisdictions and platforms. This work involves analysis of high risk activities, including the collection of sensitive datasets (such as precise location data, health data, and children’s data) and use of generative AI (such as through facial detection/recognition, profiling, and automated-decision making that has potential for algorithmic bias). Daniel combines his deep understanding of technology and privacy law to translate complex technical and legal concepts into actionable items, and help companies process data consistent with consumer expectations.

Daniel is particularly known for his special expertise in advertising technology and technology transactions, and awareness of the latest legal and industry trends. He routinely negotiates complex deals involving data flows, such as clean room agreements, data licensing/matching agreements, and media buy insertion orders. He performs due diligence on the use of SDKs and other tracking technologies, and evaluates app platform compliance, including with Apple’s App Tracking Transparency (ATT) and privacy manifest requirements. Daniel is highly involved with ad tech industry efforts to address contractual, accountability, and opt-out obligations, including through working closely with the Interactive Advertising Bureau (IAB). He also serves as a Vice President on the Board of Directors for the International Advertising Association (IAA) and helped IAA and the Global Advertising Lawyers Alliance (GALA) publish the first-ever global guide on the impact of privacy laws on marketing and advertising.

Daniel is certified as an Information Privacy Professional (CIPP/US) and admitted to practice in California. He is a graduate of UCLA and USC Law. Prior to joining the Firm, he worked in Big Law and separately was involved in the launch of a fintech startup, which was acquired by a multi-national corporation.
