Emma Waldron has a thriving practice in Education Law encompassing the full spectrum of work in this area. She has a passion for work involving special educational needs and disability, and is considered highly skilled at working with vulnerable clients. With a background in personal injury litigation, Emma is also experienced in matters involving educational negligence.

Emma’s practice has led her to support clients in the High Court, Upper Tribunal, County Court and First Tier Tribunal.

In the SEND Tribunal, Emma represents both parents and Local Authorities in all types of appeals concerning EHC Plans. She is a skillful and calm negotiator with a pragmatic approach.

Emma has extensive experience in claims against Ofsted, representing childcare providers before the Care Standards Tribunal. Many of these appeals are complex in nature and involve allegations of the utmost severity. She has successfully challenged both suspension and cancellation decisions made by Ofsted, and has advised settings on registration requirements also.

In the High Court, Emma has experience of advising and representing clients in judicial review proceedings, in particular section 42 challenges. She has also advised in high value personal injury, discrimination and breach of contract claims against Universities and Independent Schools.

In addition to her court work, Emma has considerable experience of conducting complex safeguarding investigations on behalf of Independent Schools and Universities. Typically, these involve allegations of abuse and serious misconduct.
