Kim is a leading New Zealand lawyer in the field of complex commercial, regulatory and insolvency disputes. He has over 20 years’ litigation experience, including 6 years’ London-based experience in international arbitration. Prior to Lindsay & Francis, he had 10 years at New Zealand’s largest specialist litigation firm including over 6 years as partner.

Kim has particular experience in complex commercial disputes, class actions, regulatory disputes and pecuniary penalty proceedings (having acted both for and against the FMA, Commerce Commission and other regulators) and restructuring and insolvency related disputes. He is recognised as a leading insolvency litigation and is a contributing author of Heath & Whale on Insolvency Law, as well as Morison’s Company Law, and has previously taught as an adjunct lecturer on advocacy at the University of Auckland.

Kim has particular experience in the finance sector, having been involved in the leading case on assessing consumer credit fees under the CCCFA (Sportzone Motorcycles), and multiple cases involving priority disputes between competing secured and unsecured claims and/or overlapping insolvency appointments. He is known for his rigorous legal approach balanced by pragmatic commercial advice. He particularly prides himself on his client-focused approach and developing a litigation strategy to best serve his client’s commercial needs.
