Career
Luis Ernesto Peón Barriga is a lawyer (graduated from ITAM) and holds a Master's degree in Commercial Law with honors from the University of Sheffield in the United Kingdom.
Dedicated to litigation and arbitration, he has more than 20 years of experience in different civil and commercial proceedings (ordinary, expedited, oral, special and collective actions), bankruptcy proceedings, and an extensive experience in amparo matters, derived from acts of authorities in the jurisdictional forum, acts of authority in themselves and against laws.
His experience includes the representation of companies in the context of disputes between partners and shareholders, controversies arising from product liability (in the automotive, pharmaceutical and agrochemical industries), as well as outstanding matters of tort liability (moral damages and punitive damages).
In the litigation context of the insurance sector, he has consolidated his practice, mainly representing insurance and reinsurance companies in controversies in indemnity claims, as well as advising them on a daily basis, from a preventive and adversarial perspective, on the new thresholds of the cross-cutting observance of human rights and their intersection with the industry.
In the area of alternative dispute resolution, his practice includes the representation of clients from various industries in national and international commercial arbitration, as well as in judicial proceedings related to arbitration focused on injunctive relief, nullity and enforcement of arbitral awards. Additionally, he has represented arbitrators in the defense of their awards and their professional liability.
In the financial sector, he has represented banks, stock intermediaries, various financial entities and creditors in cases of restructuring, insolvency and collection and enforcement of guarantees and securities, before local and federal courts throughout the country.
He is a partner at Hogan Lovells, where he leads the continuing education programs in the Mexico City and Monterrey offices.
His collaboration and intervention in the open parliament dialogues carried out by several associations, higher education institutions and professional associations, together with the Senate of the Republic, regarding the challenges for the effective access to justice in the context of the National Code of Civil and Family Procedures.
In the academic area, he is a professor at the Judicial School of the Judicial Power of Guanajuato (in the areas of commercial procedural law and commercial arbitration) and has been a professor of civil procedural law at the Universidad Iberoamericana, ITAM (his alma mater) and other universities.
He has several publications on commercial arbitration and civil procedural law and has co-authored several publications in specialized journals on procedural law. He has been consistently recognized by different forums in Mexico and Latin America for his outstanding professional work.
