Career
Jena MacLean has over two decades of experience representing clients in matters involving tribes and tribal lands and resources. Her wide-ranging experience includes inter-jurisdictional disputes between tribes and state and local governments, land and water claims, fee-into-trust applications, tribal-state compacts, natural resource development projects, federal preemption, and transportation infrastructure and rights-of-way. Work highlights include litigating tribal sovereign immunity litigation before the U.S. Supreme Court (Lewis v. Clarke (2017); Upper Skagit Indian Tribe v. Lundgren (2018)), challenging Indian Gaming Regulatory Act regulations on behalf of the State of New Mexico, and defending governmental entities in tax preemption challenges.
