Recent trade mark/passing off cases include: Lifestyle Equities v Santa Barbara Polo Club; Land Rover’s Trade Mark Application (for the 3D Defender mark); R v Secretary of State for Health and Karen Millen v Karen Millen Fashions.
Notable design right, copyright and breach of confidence cases include: Rothy’s v Giesswein; Shnuggle v Munchkin; Force India v 1 Malaysia Racing; Wade v BSkyB and Football Association Premier League v Luxton. Lindsay also appears regularly in the Copyright Tribunal and has particular expertise in database rights having appeared most recently in 77M v Ordnance Survey and The Kennel Club v Micro-ID, and the seminal cases of Football Dataco v Sportradar; Football Dataco v Yahoo! and BHB v William Hill.
