Career
Melvin Chan co-heads TSMP’s Construction & Engineering practice. His main area of practice is in civil and commercial litigation, where he has extensive experience in contentious construction and engineering disputes, both in Court and arbitration. Melvin is cited as a leading individual for litigation and construction and engineering respectively in Asialaw Profiles and Chambers Asia-Pacific.
In the field of building construction litigation, Melvin has successfully argued a number of landmark decisions in the High Court and Court of Appeal, including the seminal case of Chip Hup Hup Kee Construction v Ssangyong Engineering and Construction [2010] 1 SLR 658 under the Building and Construction Industry Security of Payment Act, and more recently, the case of MCST Plan No 3322 v Mer Vue Developments Pte Ltd & Ors [2016] SGHC 38, where the High Court decided for the first time in a claim by an MCST against an architect, that the architect can rely on the independent contractor defence. The decision was upheld by the Court of Appeal.
