Career
Bradley Say has been involved in some of the leading cases under the CCA 1974: for instance, he acted for the borrowers in Re London Scottish Finance Ltd (In Administration) [2013] EWHC 4047 (Ch) and Heath v Southern Pacific Mortgage Ltd [2009] EWCA Civ 1135. In recent years his focus has shifted towards cases which involve regulation under the FSMA and, in particular, regulated mortgage contracts. In addition to litigation, he has experience of advising on and drafting claims to the FOS and the FSCS. Outside his regulatory practice, he has developed a special expertise in respect of the law relating to undisclosed commissions, having acted for the borrower in Hurstanger Ltd v Wilson [2007] EWCA Civ 299, the leading case on “half-secret” commissions. In particular he has been heavily involved in an advisory capacity in motor commission claims and business energy disputes.
