Donald Ware is a partner in Foley Hoag’s Intellectual Property Department, with over 30 years' experience in IP litigation, licensing, and counseling. He has litigated patent and inventorship disputes for global biopharmaceutical, medical device and high technology companies, universities, and research institutions. He is experienced in mediation and arbitration, including as arbitrator in patent disputes. He has extensive expertise in life sciences patent litigation, including recombinant DNA, RNA interference, monoclonal antibodies, cancer immunotherapy, polymer chemistry, molecular diagnostics, and medical devices. Don has been lead counsel in numerous high profile biotech patent cases, including Dana Farber Cancer Institute v. Ono Pharmaceutical; In re Columbia University Patent Litigation; Max Planck Institute v. Whitehead Institute; Enzo Biochem v. GenProbe; and Johns Hopkins v. CellPro. He has represented universities and biotech companies in Bayh-Dole march-in proceedings in the NIH and also advises biopharma companies on biosimilars litigation under the BPCIA.
